Let’s say you are driving down the road one day and you’re sitting at a red light. To pass the time you may tune your radio or gaze out the window. Suddenly, you are jerked forward with great force. A driver has smashed you from behind! Shocked and dazed, you get out of your car to talk to the other driver. That driver says, “I’m so sorry. I was on my cell phone, not paying attention, and I didn’t notice the red light.” While this explanation may explain a common mistake, should this excuse their actions? The law says it should not, as people are required to act with reasonable care when operating their vehicles.

Let’s take it a step further: as a result of the accident you cannot work for two months. Your car is significantly damaged. You may be bed-ridden for an extended period or have to use crutches. You may have to wear a neck-brace to prevent further injury. Who is to pay for your lost wages? Who is to pay for the damage to your car and your pain and suffering? What if you were driving your car in the course and scope of your work? Should this just be an unfortunate event that you must pay for and accept? These are serious questions that deserve answers.

Usually, the doctor conducting the exam is well known with the insurance industry and makes hundreds of thousands of dollars a year conducting exams for the insurance industry. I ask you...how independent is that!?!?
