Here at C&C Law, Jim and Carrie Carroll are dedicated to representing the injured people of the Northern Tier of Pennsylvania in the Endless Mountain Region including Bradford, Sullivan, Tioga and Susquehanna counties, and our neighbors of New York in Tioga and Chemung counties in personal injury claims. ‘Personal injury’ is a catch-all phrase used when you have been injured as the result of another’s negligent, careless, or reckless actions. Our legal system is set up to provide people with compensation when others have caused them harm. Personal injury is the general area of the law that allows injured people to be made whole again. In order to do this, people recover compensation for their injuries from either the people who harmed them or the insurance company that represents the person who caused the harm.

Let’s say you are driving down the road one day and you’re sitting at a red light. To pass the time you may tune your radio or gaze out the window. Suddenly, you are jerked forward with great force. A driver has smashed you from behind! Shocked and dazed, you get out of your car to talk to the other driver. That driver says, “I’m so sorry. I was on my cell phone, not paying attention, and I didn’t notice the red light.” While this explanation may explain a common mistake, should this excuse their actions? The law says it should not, as people are required to act with reasonable care when operating their vehicles.
Let’s take it a step further: as a result of the accident you cannot work for two months. Your car is significantly damaged. You may be bed-ridden for an extended period or have to use crutches. You may have to wear a neck-brace to prevent further injury. Who is to pay for your lost wages? Who is to pay for the damage to your car and your pain and suffering? What if you were driving your car in the course and scope of your work? Should this just be an unfortunate event that you must pay for and accept? These are serious questions that deserve answers.

These exams are more commonly referred to as IME's or Independent Medical Exams, but we and C&C Law think there's nothing independant abou them. The exams are for the defense so let's just call them that-- Defense Medical Exams. Usually, the doctor conducting the exam is well known with the insurance industry and makes hundreds of thousands of dollars a year conducting exams for the insurance industry.
